One would think that 40 years of practice and a couple hundred jury trials would equip a mediator with the life lessons to foresee strengths and weaknesses in the litigation of others. I hope that is true. A goal has been to try a jury trial in every Tennessee county before I stop. That last pesky dozen or so of the 95 are elusive. Are two bench trials equal to one jury trial? If so, I’m getting close…
With about half of my work life is devoted to a civil mediation. I enjoy trying to help parties work past the hard, real and emotional barriers that impede settlement of disputes.
